Terms and Conditions

 

1. Compliance with local regulations

The applicant understands and agrees to research and comply with all local ordinances and regulations regarding flyer distribution in their designated area, including obtaining any necessary permits.

The applicant acknowledges that distributing flyers on private property (e.g., businesses, residences) requires obtaining prior permission from the property owner.

2. Professional conduct and brand representation

The applicant agrees to represent the company professionally and courteously while distributing flyers.

The applicant understands the importance of being knowledgeable about the information being distributed and answering any questions politely.

The applicant will avoid littering and dispose of any flyers responsibly.

3. Distribution methods and restricted areas

The applicant understands that placing flyers in mailboxes is prohibited by federal law unless using a postal service like Every Door Direct Mail (EDDM).

The applicant will respect ‘No Solicitation’ or ‘No Trespassing’ signs.

The applicant agrees to avoid distributing flyers in restricted areas like schools, hospitals, or government buildings without explicit permission.

4. Independent contractor status

The applicant acknowledges and agrees that they are an independent contractor, not an employee of the company.

The applicant understands that this application process does not constitute an offer of employment. Should the applicant be considered for a long-term position, any such offer will be extended in a formal, written employment agreement outlining the specific terms and conditions of employment, including but not limited to job title, responsibilities, compensation, benefits, and the duration of employment (whether at-will or for a specific term).” 

An offer letter itself is not an employment contract, but is presented for informational purposes only and does not constitute a binding employment contract.

The applicant understands that they are responsible for their own taxes, including income taxes and self-employment taxes (if not incorporated).

The applicant is responsible for their own expenses incurred while performing services under this Agreement, including travel, vehicle maintenance, and other costs.

The applicant has the right to perform services for other businesses during the term of this agreement.

The applicant has the sole right to control and direct the means, manner, and method by which the services are performed.

5. Work expectations and performance

The applicant agrees to distribute flyers according to the agreed-upon schedule and target areas.

The applicant will provide regular updates on their distribution efforts and any issues encountered.

The applicant will work outdoors in various weather conditions and be physically capable of walking or standing for extended periods.

6. Liability and insurance

The applicant agrees to indemnify and hold the company harmless from any loss or liability arising from performing services under this Agreement.

The applicant will obtain and maintain all necessary insurance coverage, including automobile liability insurance if using a vehicle and potentially general liability insurance.

7. Confidentiality and data protection (if applicable)

The applicant will keep confidential any proprietary information or trade secrets of the company that they may gain access to during the distribution process.

8. Agreement to terms

The applicant has read, understood, and agrees to the terms and conditions outlined above.
